Le concept de "constitution économique" : une analyse critique

International audienceThe market is one of the institutional forms of exercise of power in the Union. This form has sometimes been systematized by some jurists with reference to the concept of “economic constitution”, which has had some success in recent years. Yet the meaning of the concept is far from being monolithic. The present study sets out to review the political conditions of its appearance in Germany and the use that could be made of it in the doctrine, from the origins of Community law to more recent developments related to the economic and financial crisis. The concept has been used by communitarian doctrine in a sense directed towards a certain idea of economic federalism; the latest developments in the economic and financial crisis are challenging the traditional meaning of reference to economic governance.Le marché constitue l’une des formes institutionnelles d’exercice du pouvoir dans l’Union. Cette forme a parfois été systématisée par certains juristes en référence au concept de « constitution économique », qui a connu un certain succès ces dernières années. Pourtant, la signification du concept est loin d’être monolithique. La présente étude se propose de revenir sur les conditions politiques de son apparition en Allemagne et sur l’utilisation qui a pu en être faite en doctrine, depuis les origines du droit communautaire jusqu’aux développements plus récents liés à la crise économique et financière. Le concept été utilisé par la doctrine communautariste dans un sens tourné vers une certaine idée de fédéralisme économique ; les derniers développements de la crise économique et financière remettent en question la signification traditionnelle qui s’était imposée au profit de la référence à la gouvernance économique
